What Matters Most In Interstate Custody Disputes?
A parent cannot unilaterally decide to relocate with their child when the other parent is awarded periods of placement. They must seek permission from the other parent or, when that fails, from the appropriate court.
If your child is already in another state, the Uniform Child Custody Jurisdiction and Enforcement Act will determine which court has jurisdiction over the custody dispute, giving that court the authority to make decisions. In all states, however, custody modifications are always determined with the best interests of the child in mind.
Typically, that means the parent who wishes to relocate with the minor child must present the court with reasonable justifications for the move, with an eye toward how that benefits the child. They will also need to present a plan to the court that will allow the other parent to exercise their placement rights and preserve their relationship with the child. The other parent, naturally, may object to the move and seek to persuade the court to deny permission. The court cannot prevent the parent from relocating, but it can change the placement arrangements to allow the child to stay in the state of the non-relocating parent.
